On June 25, Seoul Central District Court 서울중앙지방법원 dismissed Netflix’s litigation challenging the bandwidth fee charged by SK Broadband in the South Korean market.
SK Broadband has charged Netflix extra to use its capacity, noting Netflix takes up a huge proportion of its bandwidth; Netflix challenged SK Broadband’s justification for the fees, claiming the consumers already paid for the right to use the internet service provided by SK Broadband.
The court found that the matter was between the two private parties to negotiate, and there was no freestanding rule in favor of net neutrality that nullified SK Broadband’s fees.
